| 摘 要： | 中国新型农村合作医疗的实施主要是依靠高度集中统一的行政干预和行政政策,缺乏法律的权威性和强制性。法制建设已成为制约新型农村合作医疗的瓶颈。从我国制定新型农村合作医疗法的三个方面予以论述,即一是要树立正确的立法目标和原则;二是新型农村合作医疗法的框架和主要法律制度的构想;三是如何进行新型农村合作医疗立法。

| Abstract: | China＇s new rural cooperative medical system relies mainly on the implementation of the highly concentrated administrative intervention and administrative policy,lack of legal authority and mandatory.The construction of legal system has become the main bottleneck of the new rural cooperative medical treatment.This paper analyzes the new rural cooperative medical treatment method into three aspects,that is,to establish the correct legislative goals and principles,the new rural medical cooperative law frame and main idea of the legal system,and how to legislate the new rural medical cooperative system. |
