| 摘 要： | 无权处分的法律效力一直就有争论,相关论文也非常多。通过对多种学说的分析,主张在物权行为与债权行为区分对待和物权行为有因性的前提下,对无权处分的法律效力加以区分控制。这样的理论对于建立和完善相关法律体系是非常必要的。

| Abstract: | The legal effect of unauthorized disposition has been controversial.There are more and more related thesis.Through the analysis of various theories,we can distinguish the legal effect of unauthorized disposition between juristic act of real right and juristic act of claim﹐On the premise of the independent principle and the relevance principle.The theory is highly necessary in building and perfecting the related law system. |
