司法体制改革背景下的审判委员会制度——以司法责任制为切入点

审判委员会工作机制改革，是当前健全审判权运行机制的重大问题。而落实司法责任制则是这一问题中的突出难点。地方法院对审判委员会制度的局部改良及其成效和问题，成为准确定位审判委员会制度、科学评估司法责任制落实状况的注脚。以此实践层面的地方改革和理论层面的定位评估为基础，进而提出限缩讨论范围、完善运行模式、增加开庭审案职能等建议，以最终实现完善审判委员会工作机制、有效落实司法责任制之目标。

The reform of the judicial committee is a major issue of the operating mechanism of judicial power.And the implementation of the system of judicial responsibility is the highlight of this problem.The local improvement of the judicial committee system and its effects and defects by the local courts has become the footnotes for accurate positioning to the judicial committee and scientific assessment to the implementation of system of judicial responsibility.It is the purpose of analysis to implement the system of judicial responsibility and to improve the system of the judicial committee on the basis of the local reform and the theoretical position and evaluation.
