对《中华人民共和国专利法修正案（草案）》的思考

《专利法修正案（草案）》已经人大常委会第一次审议。但其在立法宗旨、专利权内容、专利权的限制、专利权的强制许可上还存在一些值得关注的问题，立法宗旨没有突出目的，也有悖于逻辑；国有企事业单位专利的推广应用不利于深化企业改革；药品审批的专利权例外的规定不够完善。对这些问题提出了修改建议。

PROPOSALS FOR THE AMENDMENT TO PATENT LAW(DRAFT)

The Amendment to Patent Law(draft) has firstly been examined by the Standing Committee of the N.P.C..Some problems deserve attention such as the purpose of legislation,the content of patent,restriction on patent right,compulsory permit and the purpose of legislation is not conspicuous and is contrary to logic.The popularizing and applying of the patent of state-owned enterprises and institutions does no good to deepening the reform of enterprises.The examining and approving of patent with drug's approval as an exception is imperfect.The paper puts forward some proposals for modification.
