| 摘 要： | 共同饮酒人的酒后驾车劝阻责任应在共同侵权的框架下解决。但共同过错并不是这种共同侵权行为的构成要件，这并没有贬降过错本身在共同侵权行为中的作用，并扩张侵权行为的适用范围。建议在民法典侵权责任一编单独规定，与司机共饮者对司机负有相应的驾车劝阻责任。是否尽到该义务，实行加害人举证责任倒置。

| Abstract: | Co- drinkers＇ responsibilities of persuasion against drinking and driving should be placed under the framework of contributory infringement. Nevertheless, joint fault is not a constitutive requirement of such an act. It does not lower the role of common fault but expands the scope of tort. This paper studies the issues concerned. |
