论残疾人就业优先权

摘    要:残疾人的就业优先权是保障残疾人平等权的一项重要措施。残疾人就业优先权的基础是平等权,具体来说是平等原则中的"补偿原则",即"为了平等地对待所有人,提供真正的同等机会,社会必须更多地注意那些天赋较低和处于较不利的社会地位的人们"。我国在残疾人的就业优先权的立法方面应当从五个方面进行完善:1.通过正式立法明确这一权利;2.应当要求所有单位都尊重这一权利;3.扩大这一优先权利的范围,即对残疾人不仅要优先录用,而且在裁员时要优先留任;4.应当增加法律责任的规定;5.增加侵犯残疾人的就业优先权时残疾人的救济途径的规定。

Abstract:The employment priority rights of persons with disabilities are an important measure to ensure the equal right of persons with disabilities.The basis of this priority is compensation principle of the equality principle,which is for treating all persons equally,providing everyone with the real equal chance,society must pay more attention to them whose natural gift is comparatively low and social position is more disadvantageous.China ought to reform the legislation on 5 aspects in the field of the employment...
