| 摘 要： | 正当全世界都处于创业高潮时,我国的大学生创业却呈现双低（创业率低、成功率低）态势。造成这种状况的原因是多方面的,其中创业法律风险的存在及其保障机制的欠缺是其重要因素之一。对大学生创业中法律风险原因进行分析,检视大学生创业中公法、私法两个方面的法律风险,同时提出构建大学生创业保障机制,亦即外部建立良性的政府、高校、社会的互动机制,内部建立合理而有序的大学生创业内部防控机制的建议。
