网络舆论与刑事司法互动的经济分析

对司法机关来讲,权力的运行不受阻碍和监督且能直达其预期目的就是经济和效率;对网络舆论而言,权利的主张不受规制和制裁且能形成一定影响力也是经济和效率。然而,当网络舆论的触角碰及到司法权力正常运作的边界,司法机关为使权力有效运作而规制网络舆论的话语权,而网络舆论为使权利得到彰显而对抗司法机关的裁断权。显然,这两种情况的存在使得二者的经济都会受到贬损。尝试二者协商对话,司法机关与网络民众建立沟通协调机制,引导网络民众合理的参与司法,使权力的有效行使及权利的正当诉求达到经济上的双赢。
