| 法令滋彰 盗贼多有——关于《道德经》的法学解读 |

| 摘 要： | "法令滋彰,盗贼多有"是老子在《道德经》文本中唯一对实定法进行总体评价的一句话。历来学者们通过对此句中"法"与"法物"、法与刑的学理辨析使得老子在法令制度、政治国家等方面的思想逐渐清晰化。老子对于国家的法令制度这一专门领域是持谨慎与贬抑态度的。《道德经》里的法观念在于圣人之治下的有限法制之治,而这些有限法制又必须合乎自然之道,建立小国家,恢复原始的物质文明与精神文明以及自给自足的自然经济。

| Abstract: | The more laws,the more theft" is LAO Zi's only estimation on legislation in Tao Te Ching.LAO Zi had prudent and depreciatory attitude to legislation.In Tao Te Ching,he supported limited laws under control of the sage,and these laws must conform to Nature.His purpose was to build a smaller country,recover the primitive material and spiritual civilizations as well as self-sufficient economy. |
