我国死刑复核程序强制辩护制度的构建——以刑事辩护法律援助全覆盖为视角

我国死刑复核程序中法律援助缺位、辩护权行使难度大、辩护意见不受重视、法律规定粗疏且操作性差等,亟待加以完善。以刑事辩护法律援助全覆盖为契机完善死刑复核程序,主要路径在于建构我国死刑复核程序强制辩护制度,加快强制辩护的法律修订,以明确违反程序的法律后果、裁判文书说理的要求、律师执业权利的保障、异议权利的行使等事项,并提供相关可操作性诉讼规则指引。

Construction of compulsory defense system of death penalty review procedure in China: From the perspective of full coverage of criminal defense legal aid

In the death penalty review procedure in China, the lack of legal aid, the difficulty of exercising the right to defend, the lack of attention to defense opinions, the lack of legal regulations and the poor operability are urgently needed to be improved. Taking the full coverage of criminal defense legal aid as an opportunity to improve the death penalty review procedure, the main path is to construct a mandatory defense system for the death penalty review procedure in China and speed up the legal revision of mandatory defense, to clarify the legal consequences of procedure violation, the requirements of reasoning in judicial documents, the protection of lawyer''s practice right, the exercise of opposition rights and other matters, and provide guidance on relevant operational litigation rules.
