中国近现代宪法“神话”的社会学新制度主义分析

近现代以来,中国改变了皇权至上的政府组织形式,制定了宪法,建立了现代政治法律制度,从社会学新制度主义的视角出发,该过程是一个现代社会宪法神话的确立过程,即宪政观念在此过程中逐渐与它所附着的文本性规则分离,使后者主要为政权提供合法性支持而存在。它是世界范围内,源自西方社会的宪政体系制度化的结果,也是该过程的组成部分之一。

The Analysis of The Myth of Constitution in Modern Times of China in the View of the New Institutionalism in Sociology

Since modern times,China has changed the orgnization form of government,conducted constitution and set up modern political and legel system.This process is the establishment of modern constitution myth in the view of the new institutionalism in sociology.That is,the concept of constitutional government gradually seperated from its adherent textual regulations,which were made as legal support for the political power.This is the result of the instutionalization of western constitutional system in the world,and also one part of this process.
