| 摘 要： | 法律文化作为文化的一个分支,必然存在相互交流问题,其结果即是法律移植.不同的历史背景、文化传承、经济状况、思维模式使得各国的法律文化不尽相同,现实生活中有许多因素对法律移植起到推动或阻碍的作用,对这些因素进行分析并找出对策,会使法律移植更加科学化、合理化.

| Abstract: | Legal culture, as a branch of culture, there must exist mutual exchanges, and the result is law transplantation. The different historical background, cultural inheritance, finan- cial situation, thinking model make the legal cultures of different countries be quite different. In real life there are many factors that promote or hinder the role of legal transplantation, it will make the law transplantation be more scientific, rational to analyze these factors and find out the countermeasure. |
