| 摘 要： | 劳动权保障公益诉讼制度的构建,是以保护劳动公益为本质特征的,实际上也是对用人单位劳动违法行为的一种司法弹劾。它的产生并非偶然,尊重和保护人权、权力制衡和人民主权原则、公平正义原则和诉讼效益原则等,是其存在的深刻的法理基础。

| Abstract: | The construction of public lawsuit system concerning labor right security is charcterized by protecting the public interests of laborers by nature.In fact it is also a judicial impeachment of laborers＇ law-breaking action related to employers.It is not formed on an occasional basis and its foundation of deep legal theory in existence is respect and protection of human right,checks and balances of power,principle of people＇s sovereignty,principle of fairness and justice,principle of lawsuit efficiency and so on. |
