论恢复性司法在我国本土化之构建——以警察权为视角

改革开放以来,国家已形成较为完整的惩治刑事犯罪的司法制度,但当前对于修复被侵害社会关系的手段较为单一,无法适应当前经济社会发展的需要。因而,有必要从刑事犯罪的规律性着手,分析研究恢复性司法在我国本土化构建的必要性及可行性,通过整合侵害人、被害人及社区组织等社会资源,发挥我国警察机关优势,从而构建符合国情的恢复性司法制度。

On the Construction of Restorative Justice Nativism in China:from the Perspective of Police's Power

Since the reform and opening-up policy, China has established the comparatively complete justicesystems punishing criminal crime. However, at present, the means of repairing the infringed social relations arerelatively single, which can not meet the needs of the current economic and social development. Therefore, it isnecessary to analyze the necessity and feasibility of the construction of restorative justice nativism in China from theregularity of criminal offense. By integrating the social resources such as the offenders, victims and communityorganizations, the advantages of China''s police organizations, a restorative justice system should be constructed to bein line with China''s national conditions.
