| 摘 要： | 近年来大学生法律风险呈现上升态势,依据承担责任方式的不同,可分为刑事法律风险、民事法律风险和行政法律风险三类。刑事法律风险的特点是犯罪主体来源广泛、犯罪类型较为集中、犯罪手段呈现智能化、犯罪行为具有偶发性;民事法律风险的特点是失信违约风险、侵权风险;行政法律风险的特点是相对方固定为学生所在的高校、纠纷或争议的范围不断扩大。防范大学生法律风险的发生应从家庭教育因素、高校管理因素和社会治理因素等方面进行管控。

| Abstract: | In recent years, there is a rising trend of legal risk for college students. According to the different ways of college students＇ responsibility, legal risk can be divided into criminal legal risk, civic legal risk and the risk of administra- tive law. Control and management must be conducted from the aspects of family education, university management and social governance, in order to prevent the happening of students legal risk. |
