| 摘 要： | 公海应只用于和平目的是海洋法中的一项一般原则。它完全符合《联合国宪章》的宗旨和原则，它也适用于专属经济区。缔约国在根据《联合国海洋法公约》第301条之规定行使其权利和履行其义务时，应不对任何国家的领土完整或政治独立进行任何武力威胁、使用武力，或以任何其他与《联合国宪章》所载国际法原则不符的方式进行威胁或使用武力。但是，这一原则既不限制也不禁止任何特殊军事活动，只要这种活动与上述第301条规定的原则不相违背。但军事活动不包括法律执行活动，且为军事目的而进行的海洋科学研究禁止在海洋的任何部分进行。然而这个问题至今仍然困惑着许多国家和学者。
