| 摘 要： | 通过对有关船员外派业务现行立法的考察，以船员服务机构不同的法律地位及其法律性质为基础，分析船员外派中船员劳务中介和劳务派遣的复合法律关系，进而明确了船员、船员劳务外派企业（船员服务机构）、境外船员用人（工）单位三者之间的权利义务。

| Abstract: | On study of the current regulatory regime over the Chinese seafaring labor service export,this paper analyzed the legal status and legal nature of the seafaring service agent,the compound legal relationship of the seafaring labor intermediary and seafaring services dispatch,further drawn out the rights and responsibilities among the three parties(the dispatched seafarers,the seafaring service agent,and the overseas employer) in Chinese seafaring labor service export. |
