试谈公务人员贪污贿赂犯罪惩治的刑事立法

贪污、贿赂是严重侵害国家经济利益 ,妨碍国家经济建设 ,腐蚀干部队伍 ,损害国家机关威信 ,污染社会风气 ,具有极大社会危害性的犯罪行为。只凭一次或几次集中打击 ,是根本铲除不掉这个社会“毒瘤”的。我们认为 ,应有必要把贪污罪与贿赂罪一同并入渎职罪 ,适当调整贪污、贿赂犯罪的量刑幅度 ,降低起刑点 ,从严掌握贪污、贿赂罪与非罪的界限 ,提倡重刑与轻刑并举 ,增加对公务人员贪污贿赂犯罪的罚金刑与资格刑的适用 ,最终完成司法解释与业务规范的合作 ,取得与公务人员贪污贿赂犯罪斗争的胜利

To Talk about the Criminal Legislation on the Public Functionary's Bribing and Corruption

Bribing and corruption is the manism barm criminal act which encroach the national economic benifit badly; hamper the construction of national economic; corrupt the ranks of cadres; decline the prestige of the state organs; and pollute the climate of the society. We cannot wipe off this "malignant tumour" thoroughly only by one or a few concentrative strikes. As we considered, it is necessary to combine the bribe crime and the corruption crime into the crime of the misconduct in office, adjust the extent for measurement of punishment in the bribe crime and corruption crime appropriately, lower the point of the Punishment, master the demarcation line between bribe and corruption crime and uncrime strictly, advocate the use of the light and heavy punishment, increase the scope of application for the fine punishment and qualification punishment, complete the cooperation of the judicial explaination and professional work's standard, so we can achieve the victory; over the public functionary's bribe crime and corruption crime.
