| 摘 要： | 本文从我国非诉行政执行的现状入手,对非诉行政执行权的分布和非诉行政执行的实际运作作了较为细致的实证分析,进而从制度生成的历史和法理基础方面探究我国非诉行政执行存在的制度缺陷.最后,从比较法的路径对我国非诉行政执行以及整个行政强制执行制度作了重构尝试.

| Abstract: | The paper,starting with the status quo of noncontentious administrative implementation in China,offers a meticulous positive of the execution-power distribution and exercise of the noncontentious administrative implementation.It then probes into the institutional defects of China's noncontentious administrative implementation in terms of its history and legal principles.Finally,it attempts to reconstruct the system of noncontentious administrative implementation and the overall administrative enforcement in China from the perspective of comparative law. |
