| 摘 要： | 国际贸易惯例的产生和发展历程决定了国际贸易惯例是任意性规范,它的效力具有既存性和间断性等特殊性。一旦当事人选择国际贸易惯例便对其产生拘束力,法院不应具有主动适用国际贸易惯例的权力。国际贸易惯例的效力受国内法的强制性规范和公共秩序保留的限制。

| Abstract: | The process of international trade convention producing and developing decides that the international trade convention is aregulation with randomicity, its effectiveness has the particularity of existence of the time and discontinuity. In case the parties chooseto constrain them in accordance with international trade convention, the court should not have the right being applicable to the interna-tional trade convention initiatively. The effectiveness of international trade convention is restricted by compulsive regulation of domes-tic law and public order reservation. |
