论完善减刑运作机制

由于中国的刑事法律对减刑的运作机制缺乏科学构建,减刑决定权由人民法院行使,减刑监督权由人民检察院行使,刑罚执行机关尤其是监狱部门只能行使提出建议权,因而减刑工作经常处于尴尬之中,甚至出现非常被动的局面。这既不利于实现刑罚的目的,也容易导致偏离司法公正。从完善减刑的调控机制、激励机制、约束机制三方面入手加以分析研究,力图全力构建科学、合理、有效的减刑制度,并建议刑事立法部门对相关法律作适当修改。

On perfecting the using system of commuting a sentence

In our country,because the laws lack the using system of commuting a sentence,the decision for commuting sentence depends on tho people's court,however,the supevising right is performed by the procuratorate.The punishmentary units,especially the prisons,can only give advice,so the work of commuting a sentence is often in trouble.All of these are not only bad for achieving the aims of punishment,but easy to diverge the judicial fair.This article analyzes the systems of adjusting,encouraging and restraining mechanisms,and tries to set up a scientific,rational and effective system of commuting a sentence and advises the legislative body to revise the relavant laws.
