| 摘 要： | 目前，一些地方在土地征收过程中，侵害农民切身利益的职务犯罪时有发生。由于此类案件的犯罪嫌疑人多为农村村民委员会组成人员，对其行为进行定性的法律依据甚少，导致在具体办案过程中，法律适用问题成为一大难题。只有以具体案例为依据，以犯罪主体的认定为切入点，才能弄清涉及土地补偿费、安置补助费和地上附着物及青苗补偿费的职务犯罪的法律适用问题。
