中国—东盟打击跨境电信网络诈骗犯罪案件警务合作机制研究

中国—东盟跨境电信网络诈骗犯罪案件呈逐年递增趋势。中国在打击此类跨境犯罪方面存在取证、追赃、抓捕等诸多困难，需要与东盟国家进行警务合作。基于双边良好的政治基础和法律基础，中国—东盟已开展了警务情报信息共享、联合抓捕犯罪嫌疑人、移交遣返嫌犯、派驻警务联络官等警务合作方式，但仍存在合作依据的法律资源供给不足、警务情报信息共享机制尚未正式建立、执法合作机制尚待完善等相关问题。因此，中国与东盟国家之间需要进一步夯实打击跨境电信网络诈骗犯罪警务合作的法律基础，完善警务情报信息共享机制，探索设立统一警务合作机构。

Research on Police Cooperation Mechanism Between China and ASEAN in Combating Cross-Border Telemarketing Fraud Crime Cases

China-ASEAN cross-border telemarketing fraud cases are increasing year by year.China has difficulties in obtaining evidence,recovering criminal property and arresting criminals on these cases,and needs cooperation with ASEAN countries in police work.Based on good political and legal foundation,China and ASEAN have already developed police cooperation mode such as police intelligence sharing,joint arrest of suspect,transferring repatriated suspect and resident police liaison officer.However,there are still some related problems,such as the insufficient supply of legal resources on which cooperation is based,the informal establishment of the police intelligence information sharing mechanism without being formally extablished,and the improvement of the law enforcement cooperation mechanism.So China and ASEAN need to tamp the legal foundation of cross-border telemarketing fraud police cooperation,perfect police intelligence information sharing mechanism and explore the establishment of a unified police cooperation organization.
