我国科技行政法单独立法的理论分析

通过对科技行政法含义的重新界定,得出了科技行政法是行政法分支的结论。无论是从科教兴国战略和依法治国方略的角度,还是完善行政法体系和解决我国科技行政法整体性缺失的角度,科技行政法单独立法都是必要的,行政法一般理论、科技法学界的研究成果、国外成熟的立法经验以及国内现有立法都已经为科技行政法的单独立法提供了理论与现实上的可行性。在分析必要性与可行性的基础上,从立法模式和立法层次两个方面提出了建构独立的科技行政法体系的具体对策。

Theoretical Analysis of Independent Legislation on Sci-tech Administration Act in China

Draws a conclusion that the sci-tech administration act is an integral part of the administrative law through redefining the act.In view of the strategies of developing China by relying science,technology and education and of ruling the country by law,and from the angle of perfecting the administrative law system for lack of a law involving sci-tech administration act in China,the independent legislation of sci-tech administration act is indispensable.The general principles of administrative law,research achievements of the sci-tech law and experience from domestic/foreign legislation are all available to provide the independent legislation with theoretical and practical basis on which some suggestions are given in reference to legislative mode and procedure.
