后福岛时代核安全领域国际法的发展与改进路径研究

福岛核事故对切尔诺贝利核事故后形成的核安全国际法框架构成严重的挑战。国际法没有及时反映核安全变化的形势,对自身存在的缺陷也没有自我更新,无法保障核安全。因此福岛核事故之后,国际社会积极推动核安全国际法的改革,但如何对核安全条约进行实质性修改没有达成一致,只是形成了一些没有法律约束力的国际文件。国际核安全法仍需在吸取福岛核安全事故教训的基础上,顺应国际核安全最新要求,寻求进一步发展。

Research on the Development and Improvement Path of International Law in the Field of Nuclear Safety in the Post-Fukushima Era

Fukushima nuclear accident poses a serious challenge to the framework of international law on nuclear safety formed after Chernobyl nuclear accident. International law has not reflected the changing situation of nuclear security in a timely manner, nor has it updated itself with regard to its own defects, thus failing to guarantee nuclear security. After the Fukushima nuclear accident, the international community has actively promoted the reform of the international law on nuclear safety. However, no agreement has been reached on substantive amendments to the Nuclear safety Treaty, and only some international documents without legal binding force have been formed. International nuclear safety law still needs to be further developed on the basis of drawing lessons from Fukushima nuclear safety accident and conforming to the latest requirements of international nuclear safety.
