论案例教学法在法学教学改革中的实施

我国法律教学由于长期以来受计划经济体制影响,过于注重理论而忽视学生法律实务的操作能力。随着我国市场经济的发展以及加入世贸组织,越来越需要高素质的法律实务人才,而这也要求法律课堂教学改变以往的教学方法,顺应社会对法律人才的需要。案例教学法是推进素质教育,培养高水平的应用型法律人才的重要途径。此教学法具有启发性、实践性、民主性的特点,可以采用课堂讨论、模拟法庭、观摩审判、多媒体等模式。搞好案例教学要精心挑选案例、遵循教学原则、增加实践性教学环节时间、与司法实践部门密切合作、实行小班授课制、强化模拟法庭的保障机制。

On the Enforcement of Case Teaching Method in the Reform of Law Teaching

Affected by the planned economic system for a long time,our law teaching emphasizes on theory too much and ignores students operational capacity of practice of law.With the development of Chinese market economy and accession to the WTO,high-quality legal practice talents are more and more required,which also requires law classroom teaching to change previous teaching methods,in response to the need for legal talents.Case teaching Method is an important way to promote quality education and training high-level legal talent applied.This approach has enlightening,practical and democratic characteristics,which can be used in the classroom discussion,a mock court,observing the trial,multimedia,and other models.To do a good job of cases teaching,we must select cases carefully,follow the principle of teaching,increase practical teaching part time,cooperate with judicial practice closely,implement a small class teaching system,and strengthen protection mechanism of mock court.
