| 摘 要： | 由于目前我国法律关于黑社会性质组织的规定过于原则与笼统，致使在理解与认定黑社会性质组织犯罪上存在着不确定性与随意性。为准确认定与精确打击此类犯罪，根据近年来同涉黑犯罪作斗争的实践经验，对黑社余陛质组织根本特征与法律特征进行了分析，并就司法实践中关于黑社会性质组织犯罪的争议焦点与适用法律难点进行了辨析，在此基础上提出针对性司法建议。
