加入WTO对中国经济特区立法之影响

中国入世之后 ,经济特区特殊优惠政策的继续存在是否有违WTO国民待遇原则 ,有人对此很疑惑。毫无疑问 ,中国的入世确实给经济特区立法带来了一定的影响。然而 ,我们也应看到WTO非歧视性和国民待遇原则在其适用范围上的有限性及其诸多例外性的条款 ,WTO并不排斥特殊经济区的存在以及对其区域内的企业提供优惠安排的做法。因此 ,加入WTO后的经济特区及其立法仍然有其存在的空间 ,只是对经济特区的立法提出了更高的要求。

Entry into WTO and the Legislation in SEZs in China

Some people are worried that the existence of the special preferential policies in SEZs would violate WTO rules and principles after Chinas entry into WTO.Undoubtedly,the entry into WTO of China has inevitably affected the legislation in SEZs.However,we should also see the limit and exceptions of the non discrimination and national treatment principles in the process of application.WTO does not exclude SEZs and the preferential arrangement for the enterprises within SEZs.Therefore,there is still space for SEZs and legislation inside SEZs,but a higher demand has been raised in terms of legislation as a result of the entry into WTO.
