| 摘 要： | 司法三段论将作为大前提的法律规则和作为小前提的案件事实舍乎逻辑地推导出判决结论是实现司法裁判正当性的一种基本模式，同时由于司法裁判在法律解释和案件事实问题上必须进行价值判断，因此，逻辑与价值判断构成了司法三段论的两个基本内容。

| Abstract: | The judicial syllogism is the fundamental judicial judgment pattern to legalize a judicial judgment that deduces a judl- cial conclusion based on the major premise of legal rules and the minor premise of the law suit. At the same time, the judicial judgment should have the value-judgment on the legal explanation and law suit, so the logic-judgment and the value-judgment are two fundamental elements of the judicial syllogism. |
