| 摘 要： | 关于合同终止与解除,在我国法学界存在包容说和并列说两种理解,且对现行立法产生重大影响。就我国《劳动合同法》立法而言,选择终止与解除并列说作为劳动合同关系终结的理论基础,能合理规范劳动合同关系、公平调整当事人的权利义务,更能充分体现《劳动合同法》公法兼私法的社会法特征。

| Abstract: | There are two opinions on the termination and revocation of a labor contract: the Parataxis and the Containing.These two opinions put empression on the labor legislation now.The author regards it is better to normalize a labor contract relation ending if the parataxis opinion is chosen to be the base.Then,the interest of employers and employees can be protected better. At the same time,the Labor Contract Law,having the character of the public law and the private law,can be regarded as a real social law. |
