| 摘 要： | 一般认为,法律文书主旨包含写作目的与中心思想两方面内容。但写作目的与中心思想的确立是一个前后相继的思想过程,它们的形成源自截然不同的思想活动;而且,写作目的与中心思想对于法律文书写作分别有着相关而又各自独立的意义,因此,应破除主旨的概念,让写作目的与中心思想获得独立的要素地位。

| Abstract: | Generally,primary intention of legal document contains writing goal and central thought.But establishment of writing goal and central thought is an around one after another thought process.Moreover,writing goal and the central thought write has separately different significance,Their formation also is produced from entirely different thought activity.Therefore,writing goal and the central thought are independent essential factors.Some questions shall be reconsidered on the base of the above-mentioned viewpoint. |
