| 摘 要： | 商标与商号的权利冲突是近年知识产权保护的热点和难点问题。我国现行立法对商标和商号分别予以保护,针对由此产生的商号权与商标权的法律冲突现状,提出解决两权冲突的有效途径为统一我国商标与商号的法律规定,并将商号纳入知识产权保护体系。同时在现阶段通过合理的法律解释,解决二者冲突。

| Abstract: | Conflicting rights between trade firm and trademark have become the focus and nodus in intellectual asset protection.According to the actuality that trade firm and trademark are protected respectively,the author holds that unifying regulations is an effective solution to deal with the conflict.Besides,explaining current regulations reasonably is a way to resolve the conflict. |
