互联网领域不正当竞争行为的判定

互联网领域新型不正当竞争行为具有与传统不正当竞争行为不同的特点，应对其进行类型化。把行为违反了客观规范作为判断互联网不正当竞争行为的起点较为符合法律思维。我国《反不正当竞争法》中的一般性条款可以用来作为判断不正当竞争行为的依据，无需创造新的规则。在判断要素的衡量上，至少应当包括商业模式、对互联网用户的影响、流量与数据、行业与自律规范。
