“互联网+”时代我国电子商务平台法律定位之反思

当前我国电子商务平台的法律定位十分不明确，首先体现为法律概念表述混乱，其次体现为法律关系界定模糊，再次体现为裁判角色资格存疑，最后体现为义务标准适用笼统。“互联网＋”时代的到来，需要对我国电子商务平台的法律定位进行反思与重解，从法律概念的重新规范、法律关系的重新审视、裁决身份的重新考量以及审查义务的重新确立四个方面完善我国电子商务平台的相关制度和规定，从而推动我国电子商务行业的健康长远发展。

Reflection and Refactoring about the Legal Position of Electronic Commerce Platform in the Internet Plus Era

In China,The legal position of electronic commerce platform is not clear utterly nowadays.First of all,the conceptual expression is disordered. Secondly, the legal relationship is cloaked in ambiguity.Thirdly,the role of referee qualification is in doubt.Lastly,the applicable standards of obligation is general.With the arrival of the internet plus era,in order to improve the relevant system and regulations of China''s e-commerce platform and promote the healthy and long-term development of China''s e-commerce industry,we need to reflect and restructure the legal position of the electronic commerce platform in our country,which includes re-regulating the legal concept,re-examining the legal relationship,re-considering the referee status and re-establishing the review obligations.
