| 摘 要： | 从经济分析观点的视角看,我国民事诉讼法中的被执行人生存权保障规则并非尽善尽美,由此,在司法实践中亦衍生了诸多问题,存在应然与实然的背离,因而亟待立法完善,以矫"过正"之枉,使申请执行人的权利受到应有的保护,并在实现公平——兼顾被执行人生存权保障和申请执行人私权实现的基础上提高执行的效率。

| Abstract: | Rules on protecting subsistence rights of a person subjected to execution in our country's civil procedure law are not so perfect from the viewpoint of economic analysis,and they are deviating from their ought-to-be in juridical practice.So,in order to provide due protection for applicants and enhance the execution efficiency based on impartiality,these rules should be improved in future legislation. |
