| 摘 要： | 家庭是社会的细胞,是构建和谐社会的基本单位;婚姻自由是社会发展和人类进步的必然要求,在倡导婚姻自由的同时,我们还必须处理好其与家庭稳定的关系。离婚损害赔偿制度是离婚救济措施中的重要一环,为了发挥其应有的作用,我们应该严格区分它与家庭内部一般侵权的关系,进而构建完整的权利救济体系。

| Abstract: | Family is the cell of the society,and the basic organization to construct the harmonious society.The freedom of marriage is the requirement of the social development and the human advancement.When the freedom of marriage is proposed we must properly deal with the relationship between it and the stability of family.The institution of divorce compensation is one of the helping measures used when divorce happens.In order to make it more useful,we should strictly distinguish it from the ordinary inter torts to make the helping system more integrated. |
