| 摘 要： | “法治”与“德治”都是治国的方略 ,而且从功能上看二者是相辅相成、互相结合的。但从法律与道德在治国中的地位上来看 ,二者并非是平等的 ,有一个主次之分。目前我国正处于市场经济条件下 ,法律应处于主导地位 ,道德只能处于辅助地位。

| Abstract: | The rule of law" and "the rule of virtue" are China's two State strategies which are interlinked and complementary. But law and ethics are not equal in governing the country, and the former plays a principal role and the latter, a secondary role. In a market economy, law should maintain its leading position and ethics can only exercise its auxiliary functions. |
