| Abstract: | The judge's ascertaining and fixing the rights through the lawsuit depends on the substantial laws as well as the other factors in the proceedings. The substantial justice has concretized an impartial judgement inevitablely relying on the procedual justice. Ultimately the procedual justice and the substantial justice are interrelated, but in the meantime the procedual justice has been keeping its own relative independent value. |
