| 摘 要： | 我国物权法没有规定社会性居住权,居住关系由其他相关法律规定进行调整。现行的社会性居住权立法模式缺乏社会性别意识。以社会性别平等的视角,重新审视社会性居住权立法模式,阐述社会性居住权立法目的和功能,并进行社会性居住权制度的理论构造和制度设计,以实现实质意义上的平等。
