| 摘 要： | 票据行为的法律性质是确立票据行为法律规则的基础.票据法理论上有关票据行为性质的契约说、创造说和发行说,各有其缺陷和不足之处.文章在比较评析的基础上,认为创造说更具有合理性,并提出我国票据法应采创造说的主张.

| Abstract: | The legal nature of paying bill activity is one important basis of paying bill law. The article first Compares Contract Theory, Creation Theory and Delivery Theory finding that none of them is perfect, then, it further proves the reasonableness of the Creation Theory, and based on this, suggests that China should also adopt such theory in paying bill activity. |
