| Abstract: | This paper looks into the misuse and indistinct use of the Inquisitorial Procedure, and confirms the prerequisites for formation of the Procedure. Based on clarification of the relevant concepts, the paper concludes that the Chinese Criminal proceedings do not fall into the category of the Inquisitorial Procedure. |
