| 摘 要： | 对证据属性之相关性与证据证明力之充分性的判定问题,是证据学理论研究的核心问题之一。从逻辑学的视角,探讨证据相关性研究的逻辑步骤、证据与待证事实之间的因果联系、证据相关性强度的含义及对其判定的逻辑方法,以及证据充分性的逻辑含义、单个证据及证据体系充分性的逻辑判定等问题,以期为证据学研究领域提供一种全新的、严谨的思维方式。

| Abstract: | How to judge the relevancy and the sufficiency of evidence is a key problem in the theoretical research fields of the evidence.This paper tries to probe into many problems,including logic steps about the evidence relevancy,causal link between the evidence and the fact in issue,the meaning of evidence relevancy's intensity,and the ways of judging this intensity.Of course,this paper also discusses the logic signification of the evidence sufficiency and how to logically judge the sufficiency of the single evidence and the whole evidence system,in order to provide a whole-new and precise thinking style for the research fields of evidence. |
