| 摘 要： | 沉默权问题不仅是诉讼法学上的问题也是宪法学上的一个问题。沉默权不仅具有宪法基本权利形式上的特征而且具有宪法基本权利实质上的特征。将沉默权作为公民的基本权利之一加以规定,符合现代社会宪法基本权利内涵及种类不断扩张的要求。不仅如此,在宪法基本权利中谋求沉默权的合法地位,既是民主和法治的基本要求,也是保障犯罪嫌疑人基本人权的要求,而且还符合宪政意义上的价值观。

| Abstract: | The right of silence is the issue not only related to procedure law but also ralted to the Constitution.It has the characteristics in form and nature of fundamental rights of the Constitution.To entitle the right of silence to citizens conforms to the enriching of connation and type of constitutional fundamental rights.Moreover,legitimate position for the right among constitutional fundamental rights is the request both of democracy and constitutionality and of ensuring suspected offenders' fundamental human rights.In addition,it conforms to the values of constitutional government. |
