| 摘 要： | 在附带民事诉讼中确立精神损害赔偿制度是立法和司法的内在要求,是全面保护权利主体的合法权益、制裁侵权行为的需要,同时也是完善我国精神损害赔偿法律体系,顺应国际立法全面保护人格权发展趋势的需要,国家应在立法上予以支持.

| Abstract: | Establishment of the system of the spiritual damage compensation in criminal supplementary civil action in criminal proceedings is the essential demand of legislation and judicature.The system can protect the lawful rights and infringement actions.It can also perfect the legal system of spiritual damage compensation in our country and conform to the developing tendency of the world to protect the personality right.Thus,our country should support it legally. |
