| 摘 要： | "法律先于立法"这一命题在哈耶克的法哲学中具有基础性的"枢纽"地位,集批判性、建设性、价值性三重意蕴于一体。批判性意蕴批判了视法律为立法产物的错误观点,建设性意蕴肯定了立法的积极作用,价值性意蕴表明了(自生的)法律优先于(立法的)法律。正确理解"法律先于立法"这一命题,也就把握了哈耶克法哲学的精髓。

| Abstract: | "The proposition of Law is older than legislation" had a key position in Hayek' legal philosophy,which contained three meanings of criticism,construction and value.The critical meaning critisized the false view that law is the product of legislation,the constructive meaning affirmed the positive effect of legislation,while the valuable meaning made clear that(self-born) law excels(legislative)law.To understand the proposition that Law is older than legislation correctly means we can grasp the essence of Hayek's legal philosophy. |
