| 摘 要： | 以惩罚性赔偿金的运用为代表的民间打假是一个理论和实践中争议较大的问题.民间打假可以有效弥补政府打假所存在的缺陷,因而应当得到法律支持.民间打假的法律障碍主要是法理念问题和立法不完善.必须更新法理念,在相关的立法中建立和完善我国惩罚性赔偿制度,以充分发挥民间打假在维护法律权威,维护市场经济秩序和社会公共利益中的作用.

| Abstract: | Private enforcement law is an important supply of public enforcement, but there are some legal barriers which discourage the function of private enforcement law. In this thesis the author holds that the private enforcement is an important force to enforce the law and should be supported by law. Legal barriers should be eliminated. Punitive damages system which is an important tool of private enforcement law should be established and perfected in our legal systems as quickly as possible. |
