| 摘 要： | 契约在调节社会关系时,尽可能把人的理性与情感、原则性与灵活性统一起来,具有既和谐又竞争的调节功能;小康社会的目的在于实现社会的协调、有序发展和人的全面发展,其构建需要一种特殊的治理方式来实现。因而,积极创造条件,促进契约功能的实现,通过契约来治理社会,无疑会有利于小康社会的全面构建。

| Abstract: | The contract can unify not only a person's nous and sensibility but also principle and flexibility when it adjusts the social relations. So the concept possesses harmonious and competitive adjustive function. The aim of a well-off society is the harmonious ordered development of the society and man's overall development. Therefore, we need a special governing way to realize it, actively creating the conditions of accelerating the realization of functions of contract and administering the society by means of the contract so as to benefit the building of a well-off society. |
