| 摘 要： | 与公司法之法定资本制不同,我国现行外商投资企业法对外商投资企业规定的是授权资本制。因其固有缺点所决定,授权资本制引发了诸多外商投资企业出资不到位的问题。为解决这一问题,需要结合现实情况,对外商投资企业法的注册资本制度进行改进设计。

| Abstract: | Different from capital system of Enterprises Law, according to current enterprises law of foreign investment, that of enterprises with foreign investment is authorized capital system. Restricted by its own disadvantages, the authorized capital system often leads to such problem: investment of foreign investors sometimes cannot be in place. To solve this problem, we need reform and redesign the registered capital system of enterprises law of foreign investment with the consideration of the reality. |
