| 摘 要： | 为了反击民国制宪中的右翼保守主张,推动民国第一部宪法的民主化,李大钊等领导的北洋法政学会以《言治》月刊为基地,围绕国会体制、孔教入宪、宪法颁布权等制宪热点问题发表了大量文章,有力地推动了天坛宪草的民主化（该宪法草案因在北京天坛起草,史称天坛宪草）.天坛宪草虽因袁世凯政府的极力破坏而没能颁布实施,却是中国民主制宪的伟大尝试,是中国宪法思想史上的一颗璀璨明珠,也是李大钊等推进中国民主法治的珍贵记录.

| Abstract: | In order to democratize the first constitution of the Republic of China and fight the conservatism of right wingers, LI Da-zhao, based on the journal ＇Stateship＇, published a series of papers in the topics of mechanism of congress, merging Confucianism in constitution and issuing power of constitution etc. which strongly democratized The Temple of Heaven Draft Constitution. The constitution is a great attempt in Chinese constitutional movement, a shining pearl in the history of Chinese constitutional ideology and precious record of LI Da-zhao＇s endeavor for Chinese democracy and ruling by law though it was not issued due to the blockade of Yuan Shikai＇s government. |
