两大法系在新闻自由与司法公正平衡机制中的创造

各国法律都给予新闻自由相当的尊重,但媒体不当报道司法活动会侵害到案件的公正审理并影响到法院的权威,在平衡新闻自由与司法公正两种重要的权利冲突时,大陆法系与英美法系国家呈现出不同的特色,都有自己的创造,这些理念、立法与司法实践的经验对创建与完善我国媒体与司法的法律规制将起到重大的借鉴意义.

Creation in the Mechanism of Balance between Freedom of the Press and Judicial Impartiality

Many countries have given much respect to freedom of the press,but improper reports on judicial activities from media might affect the impartiality of the trial and,in turn,the authority of the court.When dealing with the conflicts between freedom of the press and judicial impartiality,the civil law system and the common law system present distinct features with their own creation which will be used for reference to develop China's legal regulations in this respect.
